Terms of Service of e-wehikul.pl

§1 General Provisions

  1. The e-wehikul.pl website (hereinafter "the Website") is operated by CE5 Karol Kwas, 05-400 Otwock, ul. Korczaka 16 (hereinafter "the Owner").
  2. The Website is an entertainment service for sending emails with a deferred delivery date (a digital time capsule).
  3. Use of the Website is voluntary and free of charge.
  4. By using the Website, the User confirms having read these Terms of Service and accepts their provisions.
  5. The Website is intended for persons aged 16 and over. Minors may use the Website with the consent of a legal guardian.

§2 Rules of Use

  1. The User can send emails without registering. Account registration allows browsing and editing sent messages.
  2. An account unused for 12 months may be deleted along with all associated data.
  3. The Owner does not guarantee message delivery at a specific time. The Website is an entertainment service and does not constitute a professional mail service.

§3 User Obligations

  1. The User agrees to use the Website in accordance with its intended purpose and applicable law.
  2. It is forbidden to post offensive, obscene, pornographic, racist, or content that violates Polish law.
  3. It is forbidden to use the Website for sending unsolicited commercial correspondence (spam) and advertisements.
  4. It is forbidden to take actions that may disrupt or destabilize the operation of the Website.
  5. The User provides personal data of third parties (e.g., recipient's email address) only with their knowledge and consent, bearing full responsibility for the legality of providing such data.
  6. The User agrees not to infringe the copyrights of third parties.

§4 Liability

  1. The Website is solely for entertainment purposes. The Owner is not responsible for content posted by Users, their views, or opinions.
  2. The Owner is not responsible for interruptions in the Website's operation, loss of data, or any consequences of using or being unable to use the Website.
  3. The Owner is not responsible for the consequences of the User sharing their password with third parties.
  4. The Owner is not responsible for email addresses, names, and other data placed on the Website by the User.
  5. The Owner reserves the right to delete the account of a User who violates the Terms of Service, without prior warning.
  6. The Owner reserves the right to discontinue providing services at any time.

§5 Personal Data Protection

  1. The personal data controller is CE5 Karol Kwas, 05-400 Otwock, ul. Korczaka 16. Contact: through the contact form available on the Website.
  2. Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR) based on Art. 6(1)(a) (consent) and Art. 6(1)(b) (performance of a service).
  3. Scope of processed data: email address, optionally name or alias, message content, IP address, and scheduled delivery date.
  4. Data is processed solely for the purpose of providing the deferred email delivery service. It is not used for marketing purposes.
  5. Data is not transferred, sold, or shared with third parties, except where required by law.
  6. Data is retained for the period necessary to deliver the scheduled message, and then for 30 days after the delivery date.
  7. Only the Website administrator has access to personal data.

§6 User Rights Regarding Personal Data

  1. The User has the right to: access their data (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20), and objection to processing (Art. 21).
  2. The User has the right to withdraw consent to data processing at any time, without affecting the lawfulness of processing carried out before the withdrawal of consent.

  4. The User has the right to lodge a complaint with the President of the Personal Data Protection Office (UODO), ul. Stawki 2, 00-193 Warsaw, Poland.

§7 Final Provisions

  1. The Owner reserves the right to amend the Terms of Service. Users will be informed of changes through the publication of the new text on the Website.
  2. Matters not regulated by these Terms of Service shall be governed by Polish law.
  3. The Terms of Service come into effect on the date of publication on the Website.
